User Agreement

Welcome to the Internet sites of Holeman and Finch Bottle Shop. These terms and conditions govern your use of and other online information services operated or provided by Holeman and Finch Bottle Shop. By using these web sites and any emails or communications received from Holeman and Finch Bottle Shop (collectively called the "Services"), you consent and agree to these terms and conditions. PLEASE NOTE THAT YOUR USE OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE IS SUBJECT TO THE FOLLOWING TERMS ("TERMS OF SERVICE"). IF YOU DO NOT AGREE WITH ANY OF THESE TERMS OF SERVICE, DO NOT ACCESS OR OTHERWISE USE THIS HOLEMAN AND FINCH BOTTLE SHOP SITE OR ANY INFORMATION OR MATERIALS CONTAINED ON THE SITE. YOUR USE OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE SHALL BE DEEMED TO BE YOUR AGREEMENT TO ABIDE BY EACH OF THE TERMS SET FORTH BELOW. THE TERMS OF SERVICE MAY BE UPDATED BY HOLEMAN AND FINCH BOTTLE SHOP FROM TIME TO TIME WITH OR WITHOUT NOTICE TO YOU. YOUR CONTINUED USE OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE INDICATES ACCEPTANCE OF ANY MODIFICATIONS TO THE TERMS OF SERVICE.

Requirements of Use

We do not sell alcohol to persons under the age of 21 and make every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site, you affirm and acknowledge that you are over the age of 21, that the person placing the order and receiving alcoholic beverages from us is over the age of 21 and that receipt of the order is not intoxicated. At the time of pick up the order recipient must present a valid drivers license, military ID, passport or State ID for identification. If your purchase is being picked up by another party, you must send a copy of both the front and back side of your ID and the party picking up your order must also show their ID to pick up your items. Sales of $400 or more require verification of both the purchasers ID and corresponding method of payment in an effort to protect again identity fraud.

By using this site, you also agree that any alcohol purchased from us is intended for personal consumption and not for resale. If you do not agree with these conditions of use, please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, we will prosecute you fully to the extent allowable by law. As required by the Communications Decency Act of 1996, we hereby notify you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to content that may be harmful to minors.

Limitation of Liability

IN NO EVENT SHALL HOLEMAN AND FINCH BOTTLE SHOP AND/OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE HOLEMAN AND FINCH BOTTLE SHOP SITE, THE USE OR PERFORMANCE OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE, THE DELAY OR INABILITY TO USE THE HOLEMAN AND FINCH BOTTLE SHOP SITE, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY EVENTS, INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE HOLEMAN AND FINCH BOTTLE SHOP SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF HOLEMAN AND FINCH BOTTLE SHOP OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE HOLEMAN AND FINCH BOTTLE SHOP SITE, OR WITH ANY OF THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE HOLEMAN AND FINCH BOTTLE SHOP SITE. THIS SOLE AND EXCLUSIVE REMEDY IS SEPARATE AND INDEPENDENT OF ANY OTHER PROVISION THAT LIMITS HOLEMAN AND FINCH BOTTLE SHOP'S LIABILITY OR YOUR REMEDIES.

You agree to indemnify, defend, and hold harmless Holeman and Finch Bottle Shop and any of its officers, owners, agents, employees, affiliates, licensors, and licensees from and against any and all liability and costs, including, without limitation, regulatory penalties, attorneys' fees, and costs incurred in connection with any claim arising our of your use of the Services or any breach by you of these Terms and Conditions. Holeman and Finch Bottle Shop reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any matter related hereto without the written consent of Holeman and Finch Bottle Shop.

Holeman and Finch Bottle Shop shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the Services. Holeman and Finch Bottle Shop does not warrant that the Services will be uninterrupted, error free, or virus free; nor does Holeman and Finch Bottle Shop make any warranty as to the results to be obtained from use of the Services or their Content. The Services and their Content are distributed on an "as is, as available" basis. HOLEMAN AND FINCH BOTTLE SHOP MAKES NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OF IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Some states do not allow exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may or may not apply to you. In such states, the liability of Holeman and Finch Bottle Shop shall be limited to the greatest extent permitted by law. You expressly agree that the entire risk as to the quality and performance of the Services and the accuracy or completeness of the Content is assumed solely by you.

Termination of Contract

Holeman and Finch Bottle Shop reserves the right, in its sole and absolute discretion, to modify, suspend, or discontinue at any time, with or without notice, this Gateway or any of its services offered on or through any of its Gateways (or any part thereof), including but not limited to the Gateway's features, look and feel, and functional elements and related services. Termination will not limit any of Holeman and Finch Bottle Shop other rights or remedies at law or in equity. We may modify these Terms at any time. Modifications become effective immediately upon your first access to or use of the Services after the "Last Revised" date at the end of these Terms. Your continued access or use of the Services after the modifications have become effective will be deemed your conclusive acceptance of the modified Terms. If you do not agree with the modifications, then please do not access or use the Services.
